These terms govern the rental of film and video equipment supplied by AbruzzoRental di Pietro Calvarese. They apply to every rental, except where the written confirmation of an individual rental states otherwise; that confirmation prevails over these general terms.
1. Who can rent
- Rental is available to persons of legal age only.
- On confirmation we ask for a valid identity document and the Italian tax code; productions, companies, freelancers and public bodies are also asked for their VAT number and the details needed for invoicing.
- The person collecting the equipment must be the person named in the confirmation, or someone authorised by them in writing. The client remains responsible for the equipment in any case.
- For a first rental with a new client we may ask for an additional guarantee or professional references. We reserve the right not to proceed with a rental where the details provided cannot be verified.
2. Quote, booking and confirmation
- The estimate produced by the online quote builder is indicative: it is based on the price list and is neither a confirmation of availability nor a binding offer.
- We always confirm availability in writing (by email or message), together with the final quote, the dates and the amount of the guarantee.
- Equipment is booked only from the moment of written confirmation. Until then it may be taken by another production.
- If your request includes items that are not in the online catalogue, we check whether we can source them and on what terms.
3. Collection and return
- Collection and return at our premises take place by appointment at Via San Luca 60, San Benedetto dei Marsi (AQ). We do not keep fixed opening hours: the time is agreed on confirmation.
- Alternatively we deliver and collect the equipment anywhere in the region, at the place and time agreed.
- The half-days for collection and return are not counted: you pay for the actual days of use. If you collect the equipment the evening before shooting starts and bring it back the morning after the last day of work, those half-days do not affect the total.
- The rental period is the one stated in the written confirmation. Any change of dates must be agreed in writing before the rental expires.
4. Checking the equipment
- We hand over equipment that has been checked and is in working order, complete with the accessories listed on the delivery note.
- The client checks the quantity, completeness and condition of the equipment at the time of collection or delivery, and in any case before starting to use it. Any objection must be raised straight away: once use has begun, the equipment is deemed accepted in the condition in which it was handed over.
- On return we check the equipment together whenever possible. If the check cannot be carried out in person, we do it as soon as the equipment is back in the warehouse and report any issues in writing.
5. Guarantee: security deposit or insurance
- As a guarantee on the rented equipment we ask for either a security deposit or insurance cover on the rented equipment, as agreed with the client; in the second case a copy of the policy is provided to us before collection.
- The amount of the deposit is set at confirmation stage, according to the value of the equipment rented and the length of the rental. How and when it is paid is stated in the written confirmation.
- The deposit is returned on return of the equipment, once it has been checked, net of any damage, missing items, reinstatement costs or late days chargeable to the client. Where amounts are withheld, we explain in writing what they relate to.
- The deposit is not a cap on liability: if the damage exceeds the amount deposited, the difference remains payable.
6. Use of the equipment
- The equipment must be used for its intended purpose, in accordance with the manufacturer’s instructions and by competent personnel.
- The client must look after the equipment with due care throughout the rental: in particular it must not be left unattended, nor left visible inside vehicles.
- The equipment must not be modified, dismantled or repaired by third parties. If a problem arises, contact AbruzzoRental first.
- Sub-renting, lending and transfer to third parties are not permitted without our written authorisation. Written authorisation is also required to take the equipment outside the agreed area or abroad.
7. Client’s liability for damage, theft and loss
- From handover until return, the equipment is in the custody and under the responsibility of the client, regardless of who physically uses it.
- In the case of repairable damage, the client bears the cost of the repair, including any days during which the item is out of service for the work to be carried out.
- In the case of irreparable damage, theft or loss, the client is liable for the replacement value of the item, that is, the cost required to replace it with equipment equivalent in model, specification and condition.
- Missing accessories (cables, batteries, chargers, filters, cases, supports) are likewise charged at replacement value.
- In the event of theft, the client must immediately report it to the competent authorities and give us a copy of the report. Reporting the theft does not release the client from liability towards us, but it is necessary in order to claim on any insurance cover.
- The client also bears the cost of extraordinary cleaning where equipment is returned soiled beyond normal use (sand, mud, paint, liquids, smoke residue).
8. Faults not attributable to the client
- If an item stops working during the rental because of wear or a defect not caused by improper use, the client must inform us immediately and stop using it.
- If we have equivalent equipment available, we replace it as quickly as possible, at no extra cost.
- If replacement is not possible, we credit the rental charge for that item for the days on which it could not be used.
- Save in cases of wilful misconduct or gross negligence, we are not liable for indirect losses arising from the fault (production costs, crew downtime, loss of profit, reshoots).
9. Late return
- Returning the equipment after the agreed deadline without written authorisation results in additional days being charged at the list rate applied to the rental.
- If the delay prevents us from supplying the equipment for a rental already confirmed with another client, the resulting loss is also borne by the late client.
- Amounts due for late return may be withheld from the security deposit.
10. Cancellation and changes to a booking
- Cancellation of, or changes to, a confirmed rental must be notified in writing, with as much notice as possible.
- The applicable cancellation terms — that is, whether and to what extent the charge remains payable, depending on the notice given and the equipment set aside — are stated in the written confirmation of the rental.
- If we are unable to supply the equipment we have confirmed, we offer an equivalent alternative or refund in full any amount already paid, with no further liability on our part.
11. Prices, VAT and payment
- All prices shown in the catalogue and in the quote builder are excluding VAT.
- The price list is tiered: the 3-day and weekly rates are already reduced compared with the sum of the individual days. For periods beyond two weeks we apply a further reduction, which we state in the final quote.
- Payment terms and methods are agreed on confirmation of the rental. No online payment is offered or required on this website.
- Delivery and collection within Abruzzo are included
- Technical assistance on set and the presence of an operator are available on request and quoted separately: they are not included in the rental rate.
12. Processing of personal data
The data collected in order to manage the rental (personal details, identity document, invoicing details, contact details) are processed in accordance with the Privacy Policy of this website, solely for purposes connected with the contract and with legal obligations.
13. Governing law and jurisdiction
The rental contract is governed by Italian law. Any dispute falls within the jurisdiction of the Court of L’Aquila, without prejudice to the mandatory jurisdiction of the consumer’s court of residence where the client is a natural person acting for purposes outside their trade or profession.
